Tudo isso para conseguir manter seu padrão de vida que alcançou com muito esforço. Por isso, acredito que sua maior preocupação é se aposentar e diminuir esse padrão.
Então, se você deseja se aposentar e manter seu padrão de vida, mas não quer ser atacado pelas garras do INSS, leia este post até o final e presta bem a atenção nas dicas que vou te dar!
1. Formas de trabalho e de contribuição para o INSS do Cirurgião(ã) Dentista
A primeira coisa que devemos estar atentos é na forma que você trabalha e por consequência como você contribui para o INSS:
a)Como autônomo: Este cirurgião dentista geralmente trabalha em seu próprio consultório ou presta serviços para Empresas que disponibiliza equipamentos de Consultório Odontológico em suas dependências. Geralmente recebe ou emite RPA(Recibo de Pagamento de Autônomo) por realizações de serviços prestados. E dessa forma, você mesmo deve pagar a sua contribuição sobre o valor recebido (20%), lembrando que nesses casos a contribuição previdenciária é obrigatória.
b)Como Empregado: Este cirurgião dentista geralmente trabalha em Consultório de uma Empresa ou órgão público que disponibiliza Consultório Odontológico em suas dependências para atendimento de seus pacientes em horário determinado, de forma não eventual (todos os dias) e com subordinação (Chefia). O profissional recebe mensalmente seus proventos que já vem descontada a contribuição previdenciária (9%, 11%) que é obrigatória, sendo a empresa responsável pelo recolhimento.
c)Como sócio de empresa: Este cirurgião dentista geralmente trabalha em Consultório de sua própria Empresa constituída como sócio administrador ou sócio cotista. Nesta forma de execução do trabalho, o Cirurgião Dentista tem liberdade para contribuir como quiser, ou seja, a verdadeira arma contra o INSS. Diante disso, apesar de ser obrigatória, o sócio poderá contribuir quantas vezes quiser por ano e sobre o valor que quiser, por meio de pró-labore.
Se você se enquadra nas três formas citadas acima, MUITO CUIDADO, pois é nesses casos em que os maiores erros acontecem e é onde o INSS mais leva o seu dinheiro.
2. Dos tipos de aposentadorias programáveis
Definir o tipo de aposentadoria é um momento complicado e ao mesmo tempo é a chave de tudo.
Diante disso, a principal ideia que devemos ter em mente em relação a esse assunto é que para cada tipo de aposentadoria deve ser associada ao tipo de trabalhador que você é e qual a forma que você contribuiu para o INSS.
Dessa forma, cada tipo de aposentadoria possui requisitos e cálculos para remunerações diferentes.
Lembre-se, depois que você fizer o pedido e sacar a primeira parcela do benefício não é possível reverter, então tome muito cuidado nessa etapa.
Agora, vou listar todos os tipos de aposentadoria possíveis para Cirurgião Dentista:Em primeiro lugar, a reforma da previdência trouxe diversas modificações nos tipos de aposentadorias. Abaixo estão listadas todas as aposentadoria possíveis, seus requisitos e cálculos para o Cirurgião Dentista que já contribuía para o INSS antes da Reforma de 2019:
a)Aposentadoria por Idade
Homem: 65 anos de idade e 15 anos de contribuição
Mulher 62 anos de idade e 15 anos de contribuição
Valor da aposentadoria: 60% da média dos seus salários + 2% a cada ano trabalhados superiores aos 15 anos para a mulher e 20 anos para o homem
b)Aposentadoria por Tempo de Contribuição
Aqui temos as maiores mudanças que a Reforma implementou. A tendência é que a Aposentadoria por Tempo de Contribuição acabe para os novos segurados. Para aqueles que já estavam filiados ao regime, o INSS criou 4 regras de transição:
Regra de Pontos
Essa regra exige 35 anos de contribuição para o homem e 30 para a mulher, além de uma pontuação mínima que é obtida a partir da soma da idade e do tempo de contribuição. Em 2023 a pontuação mínima é 90 para as mulheres e 100 para os homens. O valor da aposentadoria é de 60% da média dos seus salários + 2% a cada ano trabalhados superiores aos 15 anos para a mulher e 20 anos para o homem.
Idade mínima
Essa regra exige 35 anos de contribuição para o homem e 30 para a mulher, além de uma idade mínima necessária que aumenta 6 meses a cada ano até 62 anos para a mulher e 65 para o homem. Em 2023, a idade mínima para o homem é 63 anos e 58 anos para a mulher.
Pedágio de 50%
Essa regra serve para os segurados que em 13 de novembro de 2019 faltavam 2 anos ou menos para se aposentar, ou seja, 28 anos para a mulher e 33 para os homens. Para esses casos, o segurado deve completar o tempo que faltava + metade desse tempo.
O interessante é que essa regra não exige idade, então pode ser uma alternativa a quem já possui um tempo considerável e está longe da idade mínima ou da pontuação.
Para facilitar, vou utilizar um exemplo: João em 13 de novembro de 2019 possuía 34 anos de contribuição. Para se aposentar, João deve contribuir por 1 ano(tempo que faltava) + 06 meses(50% do tempo que faltava).
O grande problema dessa regra é que incide o fator previdenciário sobre a média das suas remunerações, e como já falamos anteriormente, pode diminuir mais de 40% da sua aposentadoria.
Pedágio 100%
Essa regra é bem semelhante à anterior, ou seja, serve para aqueles segurados que em novembro de 2019 estavam próximos de se aposentar. Entretanto,não há exigência de tempo mínimo, assim poderia faltar mais do que 2 anos.
Dessa forma, é exigido 57 anos de idade para a mulher e 60 para o homem, além de completar o dobro do tempo que faltava.
Por exemplo: Adelaide possuía 55 anos e 27 anos de contribuição em novembro de 2019, logo para se aposentar pela regra do Pedágio de 100%, ela deve trabalhar 3 anos(tempo que faltava para os 30) + 3 anos(100% do tempo que faltava), totalizando 6 anos.
A grande vantagem desse tipo de aposentadoria é que o valor do benefício representa 100% da média de todas as suas remunerações.
c) Aposentadoria Especial-Regra Transitória
Homem: 25 anos de trabalho expostos a agentes biológicos no exercício de sua profissão + 60 anos de idade
Mulher: 25 anos de trabalho expostos a agentes biológicos no exercício de sua profissão + 60 anos de idade
O valor da aposentadoria do Cirurgião dentista é realizada através da média aritmética simples de todas suas contribuições desde julho de 1994, devidamente corrigidas monetariamente;desta média, o segurado recebe 60% + 2% a cada ano que ultrapassar 20 anos de contribuição, para os homens, ou +2% a cada ano que ultrapassar 15 anos de contribuição para as mulheres.
3. Qual a melhor Aposentadoria que um Cirurgião Dentista pode alcançar?
E eu vou falar aqui sobre a que, geralmente, é a mais vantajosa e rápida.
Estou falando da Aposentadoria Especial.
Vamos saber um pouco mais.
Este é um benefício pago aos trabalhadores que trabalharam ou trabalham expostos a agentes perigosos ou nocivos à saúde ou a sua integridade física .
Dentre estes agentes insalubres, destacam-se:
agentes químicos, como trabalho em contato com chumbo, amianto, alumínio, etc.;
agentes físicos, como trabalho em contato com ruídos acima de 85 decibéis, frio ou calor intensos, etc;
agentes biológicos, como trabalho em contato com fungos, bactérias e vírus
4. Quais são os agentes insalubres dos cirurgiões dentistas?
Pela leitura destes agentes, você deve ter uma noção do porquê é devida uma Aposentadoria Especial para os cirirgiões dentistas.
Pelo contato com a boca de seus pacientes, o profissional fica em contato com agentes biológicos, que podem causar dano a sua própria saúde.
Esse fato fica ainda mais evidente nos dias de hoje, em conta da contaminação de uma boa parte da população por Covid-19.
Como você deve saber, a transmissão desse vírus se dá através de vias aéreas.
Portanto, imagine o caso de um cirurgião dentista que está fazendo um tratamento de canal de um dente em seu paciente que está contaminado com Coronavírus sem saber.
Mesmo utilizando o Equipamento de Proteção Individual (EPI), como máscaras, pode ser que o vírus fique durante certo tempo no ar ou até mesmo em superfícies da clínica do cirurgião dentista.
Enfim, você já deve saber o provável resultado.
Porém, não só com o Covid-19 essa contaminação grave pode acontecer, mas também com outros tipos de bactérias, fungos e outros tipos de vírus.
Portanto, nada mais justo que ter direito a uma aposentadoria mais rápida em relação aos demais segurados.
Entretanto, o grande problema é alcançar este tipo de Aposentadoria, pois depende de um conhecimento técnico aprofundado para providenciar e reunir documentação conforme várias alterações da legislação que se operaram ao longos dos anos.
Isto é, todos os períodos de exercício de atividade especial exigem a comprovação, através de documentos específicos de acordo com a lei exigia a época da exposição a agentes insalubres (químicos, físicos e biológicos) e perigosos (aparelho de RX) ajudam a completar os 25 anos de atividade especial.
Porém, dependendo da época que você reuniu o tempo mínimo, pode ser que você necessite de outros requisitos.

Nesse caso, você já tem direito a uma Aposentadoria Especial, pois, antes da Reforma, o segurado conseguia se aposentar sem cumprir nenhum outro requisito.
Ou seja, tem 25 anos de atividade especial? Já pode se aposentar!
Isso é ótimo, pois o segurado pode começar a exercer suas atividades relativamente novas e ter uma aposentadoria com uma idade mediana.
Por exemplo, Jorge começou a ser dentista em 1993, com 25 anos de idade.
Se ele trabalhar de forma ininterrupta, ele poderá se aposentar em 2018, com seus 50 anos de idade.

Já trabalhava como cirurgião(ã) dentista, mas não reuniu os 25 anos até o dia 12/11/2019 para aposentadoria pré reforma (Direito Adquirido)
Essa é a hipótese dos segurados que já trabalhavam como dentistas antes de 12/11/2019, mas, até essa data, não conseguiram reunir os 25 anos de atividade especial.
Nesse caso, você irá entrar para a Regra de Transição criada pela Reforma da Previdência (em vigor desde o dia 13/11/2019).
Os requisitos foram bastante prejudiciais para os cirurgiões dentistas (e os outros segurados que trabalham com atividade especial, no geral).
Isso porque foi incluído o requisito da pontuação.
Na Regra de Transição, os cirurgiões dentistas (homens e mulheres) precisam cumprir os seguintes requisitos para conseguir a aposentadoria do dentista, nesse caso:
25 anos de atividade especial, como você já deve saber;
86 pontos.
Observação: os pontos são a somatória da sua idade, do seu tempo de atividade especial e do seu tempo de contribuição “comum”.
Isso significa que o tempo que você trabalhou em atividades não especiais também entram na contagem da sua pontuação.
Por exemplo, Carla tem 55 anos de idade e 25 anos de atividade como cirurgiã dentista realizados até setembro de 2021.
No momento, ela preencheu o requisito do tempo mínimo de atividade especial, mas não cumpriu a pontuação, pois possui somente 80 pontos.
Porém, Carla tem registro na sua Carteira de Trabalho que exerceu suas atividades durante 6 anos como auxiliar escritório num Banco antes de ingressar para a área odontologia.
Como já disse antes, este tempo também entra na conta da pontuação.
Desta maneira, Carla já pode se aposentar em 2021, pois conta com 86 pontos (55 anos de idade + 25 anos de atividade especial + 6 anos de tempo de contribuição “comum”).
Começou a trabalhar como cirurgião(ã) dentista após 13/11/2019
Caso você tenha começado a trabalhar como dentista a partir do dia 13/11/2019, você entrará na regra transitória da aposentadoria do cirirgião(â) dentista.
Ou seja, da aposentadoria especial.
Você vai perceber que esta regra é muito mais prejudicial do que a Regra de Transição, pois foi instituída uma idade mínima obrigatória para este benefício (Regra Transitória).
Na Regra Transitória, chama-se assim por que precisa que uma Lei a torne definitiva sobre o requisito idade mínima, como já falei acima, os requisitos para a aposentadoria do dentista são os seguintes:
25 anos de atividade especial;
60 anos de idade.
Aqui, nem mesmo o tempo de contribuição “comum” irá ajudar a adiantar a sua aposentadoria, pois agora o requisito é de uma idade mínima.
Vamos pensar no mesmo exemplo da Carla, que possui, até setembro de 2021, 55 anos de idade e 25 anos como dentista.
Na regra transitória, foi cumprido o tempo mínimo de atividade especial, mas não o etário.
Isto é, Carla somente conseguirá a sua aposentadoria em 2026, quando terá 60 anos de idade.
Isso é um absurdo o que fizeram com a aposentadoria dos cirurgiões dentistas e de todos que trabalham com insalubridade/periculosidade.
De forma justa, era uma aposentadoria mais rápida para quem trabalhava em situações especiais.
